HOOPS IN HAWAII SWEEPSTAKES
CONTEST VALID:
September 13th, 2010 at 12:00am PST through September 30th, 2010 at 11:59pm PST. KOMO 4 reserves the right to change these date(s)/time(s) at any time.
HOW IT WORKS:
September 13th, 2010 –September 30th, 2010 viewers go to komonews.com/hoops and enter with a photo submission showing their fan spirit for Northwest college sports teams on the Hoops in Hawaii Upickem site. Photo submissions will be viewed each weekday during the duration of the contest and if deemed appropriate, approved by KOMO 4 personnel at 8:30am PST each weekday morning. KOMO 4 and sponsors reserve the right to reject any photo submissions that are deemed inappropriate for any reason at their sole discretion. Administrator decisions are final on approval of submissions. Entrants can encourage others to register to vote and comment on their photo submission. Voters must be registered with the contesting system used by KOMO 4 (U Pick Em) and only one vote is permitted per person per day. Once a photo submission is approved – it will be available for viewing and voting for the duration of the contest on the Upickem site. The photo with the most online votes at the end of the voting period will win the Grand Prize. In the event of a tie, a random drawing will be held to determine a winner.
SPONSOR:
Hawaii Visitors and Convention Bureau (HVCB), 2270 Kalakaua Ave., Suite 801, Honolulu, HI 96815, is solely responsible for all aspects of this sweepstakes (“Sweepstakes”). This contest is also sponsored and administered by KOMO-TV/Fisher Interactive Network, 140 Fourth Ave. North, Suite 370, Seattle, WA 98109, whose decisions are final and binding as to all aspects of this Sweepstakes.
ELIGIBILITY & LIMITATIONS:
•One entry per person
•One entry per household (regardless of whether one person has more than one Address or more than one person use the same Address)
•Odds of winning depend on the number of eligible entries received.
•Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
•Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.
•This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
•Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
•Must be at least 18 years old to enter.
•. Winners will be responsible for all transportation while in Hawaii including transfers to and from the airport to the hotel and to and from the EA SPORTS Maui Invitational event.
•In the event of two individuals have the same vote totals, a random drawing will determine the winner
•Multiple or mechanically reproduced entries may result in disqualification. Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in your email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees.
•All prizes and components are not exchangeable or redeemable for cash; are subject to terms and conditions of use as stated thereon.
ONE GRAND PRIZE:
Six (6) day/ five (5) night trip for winner and one (1) guest (“Couple”) to Maui, Hawaii (“Trip”), consisting of the following elements for the Couple: [1] roundtrip coach airfare via Sponsors-selected carrier between Seattle International Airport (“airport of origin”) and Kahului Airport; [2] hotel accommodations for five nights (one standard room, double occupancy) at the Hyatt Regency Maui Resort and Spa; [3] Two tickets to attend the EA SPORTS Maui Invitational from November 22-24 (actual date TBD). All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to: round-trip transportation between the winner’s residence and the airport of origin, air/fuel taxes and surcharges, alcoholic beverages, baggage fees, fax, food, government fees, gratuities and tips, insurance, laundry service, merchandise, room service, service charges, souvenirs and telephone calls. A credit card may be required for incidentals. Carrier and hotel regulations and conditions apply. Travel from Seattle on November 20, 2010 and return on November 25, 2010.Hotel Check-in on November 20, 2010 and check-out on November 25, 2010. Travel and lodging must be taken at sponsors select dates and airports and are subject to availability, certain restrictions, blackout dates and Sponsors’ approval and must be completed by November 25, 2010.Value $6000 estimated. Due to Airline Fares this value may increase or decrease. The prize cannot be used in conjunction with any other promotion or offer. Prize elements may not be separated. Tickets issued in conjunction with the prize are not eligible for frequent flyer miles, and no code share flights may be used. Prize is not redeemable for cash or transferable, except to a surviving spouse residing in the same household. No substitution allowed except, at Administrator’s sole discretion, a prize of equal or greater value may be substituted. The prize will be awarded provided it is validly claimed by October 15, 2010, after which no alternate winner will be selected, nor unclaimed prize awarded.
THE FOLLOWING GENERAL RULES APPLY TO ALL FISHER CONTESTS:
1. No purchase is necessary to enter. Contest is subject to federal, state and local laws and is void where prohibited by law.
2. Additional Eligibility and Limitations. Participants and winner(s) must be U.S. citizens and residents of Western Washington (Snohomish, Thurston, Kitsap, Island, Pierce, Mason, Jefferson, Skagit, Kittitas, Grays Harbor, Lewis, Cowlitz, Whatcom, San Juan, Clallam and King Counties). All contest winners must disclose his or her legal name, address, telephone number, date of birth and Social Security Number. Any winner found to have supplied false or misleading information may be disqualified from the contest and therefore forfeit the prize(s). Age restrictions may apply. All entrants to any contest both imply and agree to participate in the contest and obey the rules of the contest.
Employees of Fisher Broadcasting - Seattle Radio L.L.C. and Fisher Communications, Inc., (collectively, “Fisher”) and any and all parent, subsidiary, related and affiliated companies, and their respective officers, directors employees and agents and their dependents and immediate families, as well as employees of contest Sponsors and vendors, and employees of other broadcast stations are not eligible to participate or win.
3. Release of Liability. Fisher, HVCB, HTA, their travel partners and any other contest sponsors and their affiliated companies and their respective officers, directors and employees shall be released and discharged from any and all legal claims, losses injuries, demands, damages, actions, and /or causes of actions which arise out of and/or are in any way related to the prize(s), the receipt, use and/or enjoyment of the prize(s) and/or damages or losses related to the contest. Entrants release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information If a Sponsor pulls out of a contest for reasons beyond Fisher’s control, Fisher is not responsible for continuing the contest and may substitute prizes to fulfill obligations.
4. Identification of Participants/Use of Voice and Likeness. Listeners understand that if they call-in or enter any Fisher contest (mail-in, web site or on-air) they may be called by Fisher personnel live on-the-air, or taped live-on-the-air for use as part of the on-air contest or in future advertising on any Fisher broadcast station. Listeners further understand that permission to use their voice, likeness and/or name is granted by entering to win or calling-in to win any contest on a Fisher broadcast station. Each winner further grants Fisher and their sponsors and its affiliates full permission and authority to use his or her name, likeness and/or voice in all forms of advertising without further compensation or permission. KOMO-TV reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or KOMO-TV. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
5. Website Contests. To enter a contest on a Fisher station’s website, contestants must complete all the information deemed necessary to declare a winner. No liability is assumed by the Station for any malfunction of the internet or individual computer systems. Only one entry per person may be submitted. Winning entries will be randomly selected from all valid entries received. If entry does not supply all the information deemed necessary to declare a winner, entry will be deemed invalid and another entry will be selected. When entering a contest via an advertiser’s web banner or logo hyperlink, Station is not responsible for prize fulfillment or any aspect of the contest.
6. Determination of Winner(s). Final determination of all winners will be made solely by Fisher. Any and all decisions made by the Fisher’s on-air personalities and staff are final. Contest rules are available by request from KOMO TV’s Promotions Department before September 30th, 2010. Any viewer requesting contest rules must send a self-addressed envelope to “ATTN: Promotions: KOMO 4 TV Promotions to: 140 4th Avenue North, Seattle, WA 98109. For name of winner (after October 15,2010) send a self-addressed stamped envelope to KOMO-TV/Promotions, 140 Fourth Ave. North, Suite 370, Seattle, WA 98109 email to abcpromotion@abc.com, including in the subject line the following: “Hoops in Hawaii Sweepstakes”. All results posted are unofficial until winners respond to e-mail notification. Any winner found to have supplied false or misleading information may be disqualified from the contest and therefore forfeit the prize(s).
Potential winner will be notified by email on or about October 5, 2010. At the sole discretion of the Administrator, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to notification within five (5) days after its transmission; [2] the return of an email notification as undeliverable after three (3) attempts; [3] potential winner’s failure to provide Administrator with satisfactory proof of age, identity and residency; [4] potential winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within five (5) days after it is mailed; [5] potential winner’s failure to validly claim the prize by October 15, 2010; [6] potential winner’s failure to be available to make the Trip and [7] any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsors may, in their sole discretion, award or not award the forfeited prize to an alternate winner. The winner and his/her guest will be required to sign a form whereby they promise not to criticize the State of Hawaii, or any portion thereof, as a tourist destination. The Couple must travel together on same itinerary; and a minor (as defined by state of primary residence) may not participate in the Trip unless the winner is his/her parent/legal guardian. The guest will be required to execute and return a Release of Liability prior to ticketing. The winner and guest are solely responsible for obtaining any and all necessary travel documents (valid photo I.D., credit card, etc.) before departure. All taxes are solely the responsibility of the winner, who will receive an IRS Form 1099 reflecting the value of the prize.
7. Transferability/Substitution of Prize. Prizes may not be traded or transferred. Substitutions of cash or equivalent, unless otherwise specifically stated in the contest rules are not allowed other than a substitution that may be necessary due to the unavailability of a prize. If concert, other ticketed event, gift certificate or coupon has been awarded as a prize and the concert, event, place of business, or product is postponed, rained out, cancelled or for other reasons, beyond our control, does not occur/exist, Fisher will not be responsible for replacing the prize. Prizes not redeemed by expiration date are no longer valid and will not be replaced by station.
In accepting a prize, the winner accepts to take the prize as outlined in the contest. Dates for tournament, flight departure/arrival, weekend stays, etc, cannot be changed by winner. If a changing the dates is an option, all additional expenses, change fees, etc. will be the responsibility of the winner. If winner is not able or chooses not to accept prize “as is”, winner forfeits his/her prize. Fisher reserves the right to select another winner. Winner is responsible for all costs associated with travel to any venue or event for which a prize was awarded, unless otherwise specified.
If the prize includes a trip, winner agrees to accept all blackout dates, space availability requirements, etc. established by Fisher’s prize partner(s), such as hotels, airlines, trains, ships, etc. Winner agrees that acceptance of any trip taken as a prize from a Fisher station does so entirely upon their own initiative, risk, and responsibility and winner and any travel companions will be required to sign a Travel Release and form. If the trip requires traveling outside of the United States, the winner, upon claiming the prize, must have a valid US passport. If the winner does not have a valid US passport upon winning the prize, the trip may be forfeited.
8. Requirements for Claiming Prize(s). Winner is required to complete an IRS Form W-9, Winner Affidavit of Eligibility and Release, and Travel Companion Forms before prize will be awarded. The W-9 and Winner Release will be sent to winner via mail, fax or email. Winner must bring the completed paperwork when claiming prize, or return it by fax/mail before prize will be awarded. Fisher and sponsors are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules and selection and announcement of the winner. Winners must return forms within five days being notified that they have won a prize. Winners can select one of two ways to receive prizes after completed paperwork is received: A) Prize will be mailed via the United States Postal Service. A parent or guardian must sign the release form if the winner is under age 18. Fisher is not responsible for prizes that are lost, stolen, misdirected, or damaged; or B) Prize may be picked up in person during regular business hours (8am to 5pm, Monday – Friday) at Fisher Radio (140 Fourth Avenue North, Seattle, WA 98109) by calling (206) 404-3137 to schedule an appointment for pick-up. An appointment must be made if winner chooses to pick-up prize at KOMO TV. Prizes will not be available without an appointment.
Due to a change in total value due to air fares – the winner may be asked to complete a prize fulfillment form for the estimated value and then a form with the actual value. The previous form would be eliminated.
9. Taxes and Expenses. The winner (or winner’s guardian) agrees to pay all expenses, taxes & fees not included in the prize. Fisher will report to the government any winnings totaling over $600 (in cash or fair market value) during the calendar year. Winners will receive an IRS 1099 Tax form if any winnings are reported. Winners are responsible for payment of all taxes on prize(s).
10. Amendments to Rules. Fisher reserves the right to amend the contest dates and rules at any time. If any portion of the above rules is determined to be unenforceable due to local or state laws, all other portions of these official rules remain in effect. In the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsors’ reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, Sponsors have the right, in their sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select a winner by such method as Sponsors in their sole discretion shall consider equitable; and in the event the Trip has already commenced, to terminate the Trip and return the Couple to the airport of origin as soon as reasonably possible.
11. Postponement or Cancellation of Contest. Due to news events of the day, or any reason beyond Fisher’s control, Fisher reserves the right to post-pone or cancel a contest without notice. In such instances, the contest prize may be awarded at a future date at Fisher’s discretion.
No photo entry or comments that feature nudity or offensive language will be approved. The administrator’s judgment on this is final.
